Northants 1 website and Northants Studio portal

These terms explain the rules for using:

• the Northants 1 website at northants1.co.uk, including the live player, on-demand audio and any other features (the Website)

• the Northants Studio portal at northants.portal.rivetstudio.co.uk, used by our staff, volunteers and authorised clients (the Portal)

The Website and Portal are operated by NN Local Media & Training CIC, trading as NN Media, a community interest company registered in England and Wales (company number 15618473), with its registered office at 17 Station Road, Kettering, NN15 7HH ("NN Media", "Northants 1", "we", "us" or "our").

By using the Website or Portal, you agree to these terms. If you don't agree, please don't use them.

These terms should be read alongside our Privacy Policy and Cookie Policy. If you are an advertiser, our Advertising Terms and Conditions also apply.

1. The platform behind Northants 1

The Website and Portal run on Rivet, a radio station management platform provided to us by Ghostlight Creative Media (rivetstudio.co.uk). Rivet powers our public website, live player, newsroom, schedule, on-demand audio, advertising management and invoicing.

Ghostlight Creative Media provides the platform on our behalf. It may access information held in the platform only where needed to host, maintain, support and secure it, and only under our instructions. NN Media remains responsible for the Website, the Portal and the information held in them.

Rivet also powers the website of our sister station, Peak Radio. Some features, settings and technical names are shared between the two stations.

2. Availability

We work hard to keep the Website, live stream and Portal running, but we can't guarantee they will always be available, uninterrupted or free from errors.

We may suspend, restrict or change any part of the Website or Portal without notice, including for:

• maintenance and updates

• security reasons

• technical faults, including faults with our hosting or streaming providers

• reasons outside our control

We will try to keep planned downtime to a minimum and, where we can, schedule it outside busy periods.

We may add, change or remove features at any time.

3. Listening online

Personal use. The live stream and on-demand audio are for your personal, non-commercial listening only.

What you must not do. You must not:

• re-broadcast, re-stream or relay our audio on another website, app, station or service

• record, download or copy our audio, except where a download option is clearly provided

• embed our live player or stream on another website without our written permission

• play our stream in a business or public place as a substitute for licensed background music (licensing for public performance is the venue's responsibility)

Data usage. Streaming audio uses data. If you listen on a mobile network, standard data charges from your provider may apply.

Your device and connection. Stream quality depends on your internet connection, device and browser. We support current versions of the major web browsers. Some features may not work on older browsers or if scripts are blocked.

Now-playing information. Song titles and other track information are provided for information only and may not always be accurate or up to date.

4. Interactive features

The Website includes interactive features such as song voting and optional audience questions.

• Song voting is limited to one vote per song per device. You must not try to manipulate votes, for example by clearing your browser data, using multiple devices or using automated tools to vote repeatedly.

• Audience questions are optional and anonymous. Please answer honestly if you choose to take part.

We may reset, remove or discount votes or answers that appear to have been manipulated.

5. Things you send us

You may send us content through the Website, such as contact messages, story tips, Northants Guide events, Northants Spotlight listings and competition entries.

When you send us content, you confirm that:

• it is accurate and not misleading

• you have the right to send it, including permission for any photos, logos or other material you include

• it is not unlawful, defamatory, offensive, discriminatory or harmful

You give us a free, non-exclusive licence to use, edit, publish and broadcast what you send us for the purpose you sent it. For example, we may publish an event listing on the Website or mention a story tip on air.

We may edit, decline or remove any submission at our discretion. Publishing a submission does not mean we endorse it.

Competitions are also governed by our Competition Terms and Conditions.

6. Acceptable use

When using the Website or Portal, you must not:

• try to gain unauthorised access to any part of the Website, Portal, our servers or databases

• probe, scan or test the vulnerability of our systems, or bypass any security or access controls

• upload or send viruses, malware or any harmful code

• use bots, scrapers, crawlers or other automated tools to access, copy or collect content or data, including stream metadata, without our written permission

• send so many requests that you overload or disrupt our systems

• interfere with advertising or sponsorship content in a way that misrepresents it, or create fake clicks or impressions

• impersonate anyone or misrepresent your connection with Northants 1

• use the Website or Portal for anything unlawful, fraudulent or harmful

Search engines. Standard search engine indexing that follows our robots.txt file is allowed.

Reporting security problems. If you find a security weakness, please report it to us privately at [email protected] rather than publicising it or trying to exploit it.

7. Our content

The content on the Website belongs to NN Media or the people who licensed it to us. This includes our articles, audio, podcasts, photos, graphics, logos and the Northants 1 name and brand.

You may:

• view and listen to it for your own personal use

• share links to our pages and content

You must not copy, republish, sell or commercially use our content without our written permission.

The music played on Northants 1 is used under licence and remains the property of its rights holders.

8. Links to other websites

The Website contains links to other websites, especially in the Northants Guide and Northants Spotlight sections. We show a notice when you're about to leave northants1.co.uk. We're not responsible for the content, availability or privacy practices of other websites.

9. Advertising on the Website

The Website may show advertising and sponsored content. We may display a notice if we detect an ad blocker. You can dismiss the notice and keep using the Website.

Sponsored or paid-for content is clearly labelled.

10. The Northants Studio portal

The Portal is for authorised users only, including NN Media staff, volunteers, presenters, Academy participants where relevant, and advertisers or clients we have given access to.

Your account

• We will create your account and give you access that matches your role. You must use only the features and information your role needs.

• Your login is personal to you. Do not share your password or let anyone else use your account.

• Use a strong password that you don't use anywhere else, and turn on any additional security options we provide.

• Tell us straight away at [email protected] if you think someone else has accessed your account.

• You are responsible for everything done through your account, unless you have reported that it has been compromised.

Information in the Portal

The Portal contains confidential and personal information, including details of listeners, advertisers, volunteers and Academy participants.

You must:

• use this information only for your role at Northants 1

• keep it confidential, in line with the confidentiality agreement you have signed

• not copy, download, export or share it except where your role requires it

• store anything you download securely, and delete it when you no longer need it

• not enter sensitive personal information, such as health details, unless your role requires it and you've been told to

Publishing and uploading

• Anything published through the Portal to the Website, or scheduled for broadcast, must meet our editorial standards, the Ofcom Broadcasting Code and any other applicable rules.

• Only upload files you have the right to use, such as images, audio and documents, and that are free from viruses or malware.

• Do not publish anything you are not authorised to publish.

• Scheduled content will publish automatically at the time you set, so check it carefully before scheduling.

Keep your own copies

We keep backups of the Portal, but you should keep your own copies of important files you upload, such as artwork and audio. We can't guarantee that deleted content can be recovered.

Activity records

The Portal records who logs in and what changes are made. We may review these records to keep the Portal secure, investigate problems and check that these terms are being followed.

Advertisers and clients

If you use the Portal as an advertiser or client:

• approvals, artwork submissions and instructions given through your account may be treated as given by your business

• campaign figures, such as impressions, clicks and placements, come from our own systems and are indicative only

• your use of the Portal is also governed by our Advertising Terms and Conditions, which take priority if they conflict with these terms

Ending access

We may suspend or remove Portal access at any time, including when:

• your role, volunteering, Academy place or campaign ends

• you break these terms

• we need to protect the security of the Portal or the information in it

When your access ends, you must stop using the Portal and delete any Portal information you hold, unless we tell you otherwise.

11. Features in development

We may sometimes offer new or trial features, including features that use automated tools or artificial intelligence. These are provided as they are and may change or be withdrawn. Anything produced using them is checked by our team before it is broadcast or published.

12. Our responsibility to you

We provide the Website and Portal free of charge to listeners, and "as is".

We are not responsible for:

• any loss or damage caused by the Website, stream or Portal being unavailable or interrupted

• any loss of data you upload, beyond taking reasonable care of it

• problems caused by your device, software, browser or internet connection

• the content of other websites we link to

• business losses, such as loss of profit, revenue or opportunity

We take reasonable steps to keep our systems free from viruses and malware, but you should use your own security software.

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Nothing in these terms affects your statutory rights as a consumer.

13. Changes to these terms

We may update these terms from time to time. The latest version will always be published on this page, with the date it was last updated. If you keep using the Website or Portal after a change, you accept the updated terms.

14. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
